The lien laws in New Hampshire are technical and it is easy for a Lender to lose its priority because a Mechanic’s Lien gets filed. Few Lenders know with any certainty whether their priority is still in place by the time the project is finished. This mortgage priority issue is as important as getting an appraisal or environmental site assessment from a protection perspective for your Lender.

Don’t allow your Customers to approach other Lenders for their Construction Financing needs. You may find the profitable relationship you had moving to that new institution because they had the opportunity to cross sell your Customer.

Many larger Commercial Contractors have already operated and are familiar with the ACC,LLC Construction Loan Procedure over the past 20 years.  Some of the procedure highlights are:

The ACC,LLC Construction Loan Procedure was a featured handout in the last National Business Institute’s Seminar conducted by on New Hampshire’s Mechanic Lien Laws conducted in October of 1997. 

Use of this procedure ensures a quality result by including testing at the initial stages of the project (unless directed by the Lender not to use testing). The Lender and Customer know that the project is out of the ground according to the engineering standards set forth in the plans. The cost to cure in-ground defects is substantial compared with the cost of testing.

ACC,LLC is affordable when compared with market services that fall short of providing the same level of expertise.

By using this approach to the administration of Construction Loans your Commercial Loan Officers are available during the construction period to pursue what they were trained for--go get new business that translates to profits for the Lender.

The Construction Loan Procedure developed by Bruce Armer has been in use for the past eighteen years in New Hampshire, Vermont and Massachusetts. Projects are built on time and within budget. This procedure protects Financing Institutions, Customers, General Contractors and Subcontractors and Materialmen.

                                                                                                                                                                                        Scope of Work and Payment for Services


ACC,LLC will invoice the Lender a fee to be collected at closing or immediately thereafter for:

 Use of the Construction Loan Procedure 
 Pre-closing meeting between ACC,LLC, Borrower and Contractor to go over the Construction Loan Procedure, budget, and         construction documents
 Aiding the Borrower in the collection of construction documentation necessary for closing
 Written report to the Lender concerning the economic feasibility of the project

At each disbursement period there will be a fee deducted from the disbursement for the following:

 Physical collateral review of the project and all associated requisitions and testing reports
 Certification as to the posting requirements per RSA 447 B:12
 Preparation and collection of the Owner’s Affidavit and the parallel accounting of the project 
 Collection of General Contractor’s lien affidavit and Subcontractor’s affidavits from the previous disbursement
 Co-ordination with the title attorney for the title updates at each Lender disbursement
 Written report faxed to the Bank which includes all pertinent documentation for the Lender’s file relative to the disbursement
 Digital pictures emailed to the loan officer at each disbursement period 


ACC,LLC maintains a temporary job file with all documentation that is either turned over to the Lender at the end of the project or kept
on file in this office for three years.
